Terms of Service

1. Acceptance of Terms

By accessing or using the SendMyDrugs platform (“Platform”), operated by Antigravity Labs LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and the Company. We reserve the right to update these Terms at any time, and your continued use of the Platform after such changes constitutes acceptance of the revised Terms.

2. Description of Service

SendMyDrugs is a telehealth marketplace platform that connects consumers with licensed healthcare providers for consultations, treatment plans, and medication fulfillment. The Platform provides:

• A marketplace for consumers to discover and connect with licensed providers.
• Tools for providers to manage their practice, catalog, and patient interactions.
• Secure telehealth consultation facilitation.
• Integration with pharmacy fulfillment services for prescription medications.
• Subscription management and billing services for providers.

Important: SendMyDrugs is a technology platform and does not itself provide medical advice, diagnoses, or treatments. All clinical decisions are made by independent, licensed healthcare providers.

3. Account Registration

To use certain features of the Platform, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your login credentials and not share them with others.
• Promptly update your information if it changes.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Provider Terms

Healthcare providers using the Platform agree to the following additional terms:

• Licensing: You represent that you hold all required licenses, certifications, and credentials to practice in the jurisdictions where you provide services.
• Compliance: You are solely responsible for compliance with all applicable federal, state, and local laws, including HIPAA, state telehealth regulations, prescribing laws, and DEA requirements.
• Independent practice: You acknowledge that you operate as an independent practitioner and are solely responsible for all clinical decisions.
• Standard of care: You agree to provide services consistent with the accepted standard of care in your profession and jurisdiction.
• Insurance: You are required to maintain appropriate professional liability (malpractice) insurance throughout your use of the Platform.

5. Consumer Terms

Consumers using the Platform agree to the following:

• You understand that the Platform facilitates connections with licensed providers and does not itself provide medical advice.
• You will provide truthful and complete health information to providers during consultations.
• You acknowledge that telehealth consultations have limitations and may not be a substitute for in-person medical care in all circumstances.
• You are responsible for following treatment instructions provided by your healthcare provider.
• In case of a medical emergency, call 911 or go to the nearest emergency room immediately.

6. Prohibited Uses

You agree not to use the Platform for any of the following:

• Any unlawful purpose or in violation of any applicable law or regulation.
• Impersonating another person or entity, or misrepresenting your credentials.
• Distributing malware, viruses, or any harmful code.
• Attempting to gain unauthorized access to the Platform or other users' accounts.
• Scraping, crawling, or using automated means to access the Platform without permission.
• Harassment, abuse, or threatening behavior toward other users or staff.
• Submitting false or misleading health information.
• Reselling or redistributing Platform services without authorization.

7. Payment Terms

The Platform involves two distinct payment flows. By using the Platform, you acknowledge and agree to both:

Medication Payments (CaptureHealth)

All medication orders and prescription fulfillment payments are processed through our pharmacy partner, CaptureHealth. The Company does not handle or store your medication payment details.

Subscription and Platform Payments (Stripe)

Provider subscription fees, SaaS platform charges, and other Platform-related payments are processed through Stripe, a PCI DSS Level 1 certified payment processor. You may cancel your subscription at any time through your account settings.

Refund Policy

Refund eligibility depends on the type of transaction. Platform subscription refunds are handled on a case-by-case basis. Medication refunds are subject to CaptureHealth's refund policy.

8. Intellectual Property

All content, features, functionality, software, designs, trademarks, and other intellectual property on the Platform are owned by or licensed to Antigravity Labs LLC and are protected by United States and international intellectual property laws.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANTIGRAVITY LABS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

The Company is not liable for any clinical outcomes, medical advice, diagnoses, or treatments provided by healthcare providers on the Platform.

10. Indemnification

You agree to indemnify, defend, and hold harmless Antigravity Labs LLC and its affiliates from any and all claims arising from your use of the Platform or violation of these Terms.

11. Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA).

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice.

13. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Platform after changes are posted constitutes acceptance.
